These SendJet terms add to the Substrio platform terms for the use of SendJet, the email service of Substrio. Words defined in the platform terms mean the same here. Where these terms and the platform terms differ on SendJet, these terms govern; everywhere else, the platform terms govern.
1.What these terms cover
With SendJet, we send the email of your apps to their recipients: sign-in codes, receipts, notices and every other message, through the SendJet API, its templates and the email function of a Substrio app. These terms cover every email sent through SendJet from your account, whoever wrote it.
2.Sending rules
You may send only email that its recipient asked for or expects from their relationship with you. In particular, you may not:
- send to purchased, rented, scraped or shared address lists, or to addresses gathered without the owner's consent;
- send bulk advertising to recipients who did not opt in to it;
- forge or hide the sender, use a "from" name or subject that misleads, or pretend to be another business;
- send phishing, malware, or links to either;
- keep sending to an address that bounced permanently, unsubscribed or complained;
- spread one sender's mail across several accounts or domains to get around a limit, a throttle or a pause.
You are the sender of every email your account sends. You answer for its content, its recipients and its compliance with the law.
3.Consent and unsubscribe
Consent. You keep a record of how and when each recipient of a marketing email agreed to receive it, and produce it if we ask in an investigation of a complaint.
The unsubscribe link. We add a one-click unsubscribe link (RFC 8058) and a Feedback-ID header to every email sent through SendJet. You may not remove, hide or break them. Once a recipient unsubscribes, we stop your account's email to that address, including sign-in codes and password resets, until the recipient turns it back on through the link we send them. We refuse a send to an unsubscribed address and never count it against your plan. Unsubscribe and abuse limits describes how this works.
Subscription choices in your app. Where your app records subscription choices beyond SendJet's unsubscribe, you honor every unsubscribe request you receive, by any channel, within the time the law sets and in any case within ten business days.
4.CAN-SPAM, CASL, GDPR and other email laws
You comply with every email and privacy law that applies to the email you send, wherever your recipients are. Among them:
- CAN-SPAM (United States). Commercial email identifies itself as such where required, has an honest sender and subject, names a valid postal address of the sender, and offers a working way to opt out that you honor.
- CASL (Canada). Commercial electronic messages to Canadian recipients need their express or implied consent, identify the sender with contact details, and include an unsubscribe that works for at least sixty days after sending.
- GDPR and ePrivacy rules (European Union, United Kingdom). You have a lawful basis to process each recipient's address and, for marketing, the consent those rules require. For the personal data in the email you send, you are the controller and Substrio is your processor, as the platform terms describe.
These summaries are not legal advice and do not narrow what each law requires of you.
5.Bounces, complaints and automatic limits
Bounces. When an address bounces as one that will never accept mail (an unknown recipient, a domain that does not exist, an inactive mailbox), we suppress it and refuse later sends from your account to it.
Complaints and unsubscribes. For each UTC day, we count how many of the recipients you emailed that day unsubscribed or marked your email as spam. Once your account has sent enough email that day for the rates to be meaningful, we slow your sending to one email every few seconds when a rate passes the throttle line, and stop it when a rate passes the pause line, each until the same time the next day. We publish the current lines and the slowed rate in Unsubscribe and abuse limits, and we may change them to follow the limits mailbox providers apply.
Allowances. Each plan includes a number of emails a month, and Free adds a daily cap, as the pricing page and Limits list. We refuse a send past either; nothing is sent or billed.
6.Suspension of sending
Beyond the automatic limits above, we may suspend your account's sending, while the rest of your apps keep running, when:
- your email breaks the sending rules or the law;
- a mailbox provider, a blocklist operator or an authority reports abuse from your account;
- your complaint or bounce rates stay high across days, or rise in a way that threatens the delivery of other accounts' email;
- your account sends from a domain or address it has no right to use.
We tell the owner why and what would lift the suspension. We resume sending once the cause is fixed and, where it was a list problem, once you show how the list was cleaned. Repeated or serious abuse ends sending for the account.
7.Your domains and DNS
The shared sending address. Each account gets a sending address on a shared sending domain that we run for SendJet. Use it for your account's email only. These terms apply to email from it as to any other, and we may change or withdraw a sending address that is abused.
Your domain. To send from a domain you hold, you add the DNS records shown for it in SendJet: the required ones let mailbox providers verify that the email comes from you and send bounces back to us, and a recommended DMARC record sends us the reports behind your deliverability reports. You may add only a domain you own or are authorized to send for.
What you control. Your domains, their registrations and their DNS are yours and stay with your registrar and DNS host. You keep the records in place for as long as you send from the domain, and you are responsible for the domain's reputation and for any other mail sent from it outside SendJet. If you remove a required record, we stop sending from that domain.
8.Message content, logs and tracking
We keep each message's log (its status, recipient and events) so you can see what was sent and delivered, and we delete logs older than SendJet's retention window. We track opens and clicks by default; you can turn tracking off for the account or for one email. Where the law requires your recipients' consent to tracking, or a notice of it, you obtain it or turn tracking off.
On Free, templates from SendJet's library send as the library has them; your templates and your changes to library ones send on every paid plan.
9.Delivery
We hand each email to the recipient's mailbox provider. Whether the email reaches the inbox is that provider's decision, and we do not guarantee delivery, placement or timing. Mailbox providers' policies apply to the mail they receive.
